The General Product Safety Regulation replaced the old directive with a framework built around traceability, a named responsible person inside the EU, and documentation that survives an accident investigation. It does not require a certificate. It requires that someone in Europe can be identified, that the product can be traced to a batch, and that the file exists before anything goes wrong. For a bamboo exporter, that is mostly good news: the obligations are procedural, and procedural obligations reward organised suppliers.

What the regulation covers, and why bamboo is inside it

The General Product Safety Regulation, Regulation (EU) 2023/988, applies to consumer products placed on the EU market to the extent that sector-specific EU rules do not cover the same safety objectives. That last clause is the one to read twice. It does not exclude a product because some other rule touches it; it fills the gaps left by sector rules. Food-contact rules address what a bamboo plate releases into food. They do not address whether the plate splinters, whether a finish flakes into a salad, whether a handle detaches, or whether the edges are sharp after a laser cut. Those are general product safety questions, and they are inside the regulation’s scope.

The regulation applies to products placed on the market from its application date in December 2024, with the obligations attaching to economic operators at each stage of the chain — manufacturer, importer, distributor, and the fulfilment service provider in some configurations. For a non-EU manufacturer, the operative consequence is that the obligations have to be discharged by someone established in the EU, and that someone needs your documentation.

The responsible person, in plain terms

The single most consequential change for exporters is the requirement for an economic operator established in the EU to be responsible for the product. In practice this is the importer, or an authorised representative appointed in writing, or a fulfilment service provider where that is the applicable role. The responsible person’s contact details must be identifiable on the product or, where the product is too small, on its packaging or in the accompanying document, and — importantly for e-commerce — in the online listing.

This is why marketplace listings for bamboo goods sold into the EU now ask for an EU-based contact before the listing goes live. It is not a marketplace quirk; it is the regulation reaching the online channel directly. A supplier who cannot name the responsible person for a given brand is not in a position to ship that brand into the EU, however good the product is.

Obligation

Who carries it

Evidence that satisfies a reviewer

Identify the manufacturer and importer

Product, packaging or accompanying document

Name, registered trade name, postal address, electronic contact

Identify the responsible person in the EU

Manufacturer, via appointment, or importer

Written appointment plus contact details on the product or listing

Traceability to the batch

Manufacturer and importer

Batch or serial marking, and records linking batch to shipment

Technical documentation and risk assessment

Manufacturer, held by the responsible person

Hazard analysis, specifications, test reports, care instructions

Reporting serious incidents

Manufacturer, importer, distributor

Incident file and notification through the official channel

Withdrawal or recall capability

All operators

Contactable customer list or channel records, and a recall procedure

A risk assessment for a bamboo plate, without theatre

The regulation asks for a risk assessment proportionate to the product. For bamboo housewares, that document can be short and still be genuine. The useful structure is: what the product is, who uses it, how it is used and misused, what could cause harm, what the manufacturer did about it, and what evidence exists.

The hazards worth naming are concrete. Splintering and raised grain after washing, which is a function of finish and moisture behaviour. Delamination at a glue line under heat or repeated wetting. Flaking of a coating into food or onto a hand. Sharp edges or burrs from machining and laser cutting. Structural failure of a handle or a rim under load. Small components on children’s sets. For each, the file should say what was specified — adhesive class, finish, moisture content at packing, edge treatment — and what was tested. A risk assessment that lists hazards and controls but cites no evidence is a template, and reviewers can tell.

The part suppliers underestimate. Care instructions are a safety document, not a marketing line. If the product must be hand washed to remain safe, the instruction must be on the product or its packaging in the language of the market, and it must be consistent with what the sales channel says. A bamboo board sold as dishwasher safe and labelled hand wash only is a contradiction that a complaint will expose — and under this regulation, the instruction is part of the safety case, not an accessory to it.

What the exporter actually has to produce

Four deliverables cover most of it, and none of them is expensive if the factory already works with specifications.

Product identification block. Manufacturer name, registered trade name, postal address and an electronic contact, in a form that can be printed on a small carton or added to a listing.

Batch traceability scheme. A marking method, a record linking batch to shipment, and a retention period that matches the importer’s obligation.

Technical file per product family. Specification, hazard analysis, test reports, and the artwork for the care and safety information supplied with the product.

Incident route. A named contact and an internal procedure for responding to a report within days, because the reporting clock does not wait for a factory visit.

Two operational habits make these deliverables real rather than nominal. The first is treating the batch code as data, not decoration: if the code on the carton cannot be resolved to a production window and a material lot, the traceability obligation is unmet even though a code exists. The second is keeping the technical file with the importer, not only at the factory, because the responsible person is the one who has to produce it.

How this interacts with the rest of the EU file

General product safety sits alongside, not instead of, the other obligations a bamboo article may carry: food-contact rules where the article touches food, packaging rules for what it is packed in, and the substance restrictions that apply to the materials. The failure mode to avoid is treating them as alternatives. A product can be perfectly compliant on food contact and still be non-compliant on traceability, and the second failure is the one that stops a shipment at the border or pulls a listing offline.

For a practical sequencing, start with identification and traceability because they are prerequisites for everything else, then the technical file, then the channel-facing work of updating listings and cartons. Our serving boards and plates are specified with batch marking and care instructions as standard, and the Portugal customs document guide shows how the entry paperwork lines up with the product file. If you need the technical file assembled for a specific SKU, start the OEM conversation and we will build it with the specification.

Frequently asked

<details>

Do I need a certificate to show GPSR compliance?

No certificate is issued under this framework. Compliance is demonstrated by the documentation set: identification, traceability, risk assessment and test evidence, held by the responsible person and available to authorities on request.

</details>
<details>

Who can be the responsible person?

An economic operator established in the EU — typically the importer, or an authorised representative appointed in writing, or a fulfilment service provider in the applicable role. The appointment must be documented, not implied by the commercial relationship.

</details>
<details>

Does this apply to sales through online marketplaces?

Yes. The regulation reaches distance sales directly, which is why listings increasingly require an EU-based contact and product identification. Marketplace compliance teams enforce this at listing level rather than at shipment level.

</details>
<details>

How long must documents be kept?

The framework sets retention expectations for the technical documentation and traceability records, and importers often apply their own longer periods. Confirm the current requirement with your EU importer or adviser rather than relying on a summary, and align the factory’s record retention to it.

</details>

This article summarises the EU General Product Safety Regulation as a buyer’s working reference. It is not legal advice, states no retention periods or procedural deadlines as fixed figures, and does not replace the text of the regulation or guidance issued by EU bodies and national authorities. Obligations depend on the product, the channel and the operator’s role in the chain; confirm the applicable requirements with your EU importer or a qualified adviser before placing goods on the market.

Sources

Regulation (EU) 2023/988 on general product safety — EUR-Lex.
