Duty is a percentage of it, the state tax base includes it, the invoice that supports the resale traces back to it, and the penalty if it is wrong is calculated by reference to it. Yet the customs value is the number buyers spend the least time on, because it looks like something that already exists — the invoice total. It is not. The customs value is a constructed figure, built by adding things to the price and occasionally subtracting them, and the rules for building it are international.

The starting point is the transaction value, adjusted

Under the WTO customs valuation framework, the primary basis for valuation is the transaction value: the price actually paid or payable for the goods when sold for export to the country of importation, adjusted for specified elements. “Actually paid or payable” is broader than the invoice when payment includes things that are not on the invoice — a set-off, a discount contingent on a later event, a payment to a third party at the seller’s request.

The adjustments are the part that catches importers. Certain items must be added if they are not already included in the price: commissions other than buying commissions, the cost of packing and of packing labour, the value of assists, royalties and licence fees related to the imported goods that the buyer must pay as a condition of sale, and the proceeds of any resale that accrue to the seller. Transport and insurance costs are added or not depending on whether the country uses a CIF or FOB basis for valuation, which is a national choice.

For bamboo tableware the two adjustments that matter most in practice are packing and assists. Bamboo is bulky and light, so packing is a material share of the cost, and buyers frequently negotiate a price that “includes packing” without checking whether the declared value reflects it. Assists matter more, and they are covered below.

Why tooling is the classic valuation error in OEM bamboo

An assist is something the buyer supplies, directly or indirectly, free of charge or at reduced cost, for use in the production of the imported goods. That includes materials, components, tools, dies and moulds, and engineering, development and design work carried out outside the country of importation. If you pay a factory for a custom mould to produce your private-label bamboo serving board, and that mould is used to make the goods you import, the value of the mould is an assist that has to be added to the customs value — apportioned over the production if you prefer, but added.

Almost nobody does this on the first order. The tooling invoice is treated as a project cost, the goods are declared at the FOB price, and the discrepancy sits in the file until an audit finds it. The same logic applies to artwork plates, laser engraving files developed by a designer you paid, and to components you buy from a third party and ship to the factory to be incorporated. None of these is exotic; they are ordinary OEM practice, which is why the omission is so common.

Element

Added to the customs value?

Note for bamboo ware

Goods price on the invoice

Yes — the starting point

Must reflect the actual transaction, including discounts already agreed

Buying commission paid to your own agent

No

The one commission that is excluded; keep the agency contract to prove the nature

Selling commission

Yes

Common where a trader is paid by the factory

Packing, including inner retail packaging

Yes, where not already in the price

A retail-ready bamboo set has significant packing cost

Moulds, dies, artwork plates you paid for

Yes, as an assist

Apportion over production if the tool serves several shipments

Design and engineering done outside the importing country

Yes, as an assist

Include the designer’s invoice, not just the CAD file

Royalty or brand licence as a condition of sale

Yes

Distinguish a licence to use a brand from a payment unrelated to these goods

International freight and insurance

Depends on the national valuation basis

CIF-based systems include them; confirm which basis applies to your entry

Related parties, and when the price stops being evidence

Where buyer and seller are related, the transaction value is still acceptable — provided the relationship did not influence the price. That is a test, not an assumption, and it is usually documented with a comparison against identical or similar goods sold to unrelated buyers. Where the test fails, valuation moves through a prescribed sequence: identical goods, similar goods, deductive value, computed value, and finally a fallback method applied flexibly.

This matters for bamboo because group structures are common: a Hong Kong or Singapore trading entity buying from a Chinese factory and selling to a Brazilian affiliate is a related-party chain, and the price between the entities is not automatically the customs value. Jurisdictions differ on whether the earlier sale in a successive-sales chain can be used — the first-sale approach — and the answer is not the same everywhere. If you have a related-party structure, this is the point where a specialist is cheaper than a correction.

What a defensible file looks like

The test of a valuation file is whether a stranger could reconstruct the declared value from the documents without asking you a question. In practice that means: the commercial invoice, the packing list with packing costs identified, the tooling and design invoices with the apportionment calculation, the transport and insurance documents, and a short note explaining any adjustment made or any element deliberately excluded, with the reason.

Three habits make the difference. Keep the tooling invoices with the shipment file rather than in a project folder, because the person who prepared the entry will not be the person who bought the mould. Reconcile the declared value against the invoice issued for the resale, since an unexplained gap between import value and first sale value is the pattern that attracts attention. And when the price changes mid-season — a volume rebate, a freight surcharge absorbed by the seller — record why, because an adjustment without a document looks like an adjustment without a reason.

Our guide to the import file for Brazil sets the valuation documents in the order the declaration needs them, and the US cutting board guide shows how the same file is assembled for a different customs regime. Buyers structuring an OEM programme can request a quote with the tooling scope stated, so that the assist is visible at the quotation stage rather than at the audit.

Where this guidance stops. We do not publish duty rates, valuation thresholds or penalty figures here, because they are national, they change, and a number from a secondary source in a customs file is a liability. Nor do we state a position on whether a particular jurisdiction accepts first-sale valuation for a particular chain; that is a question for your broker or despachante with the current national rules in front of them. What we will say with confidence is that the assist on tooling is the most frequently missed adjustment in OEM bamboo, and that it is missed by nearly everyone on the first order.

A five-minute check before the next entry

Does the invoice price include the inner retail packing, and is that visible on the packing list?

Did you pay for a mould, a die, an artwork plate or a design used to make these goods? If yes, has it been apportioned and added?

Is there a commission, a royalty or a brand licence connected to this sale? Which kind?

Are you and the seller related, and is there a comparison file supporting the price?

Does the declared value reconcile to the first resale invoice, with the difference explained?

Five questions. On a container of bamboo ware the difference between answering them and not answering them is not a rounding error — it is the exposure that follows the goods for years after they have been sold.

Frequently asked

<details>

Is the customs value the same as the invoice value?

Not necessarily. The transaction value starts from the price actually paid or payable and is then adjusted for specified elements such as packing, assists and certain royalties. Where those exist, the customs value is higher than the invoice total.

</details>
<details>

Do I have to declare a mould I paid for?

Where the mould is used to produce the goods you import, its value is an assist and must be added, apportioned across production if appropriate. The same applies to design and engineering work carried out abroad and supplied free to the factory.

</details>
<details>

What if the factory and the seller are related companies?

The transaction value can still be used if the relationship did not influence the price, and that is normally demonstrated by comparison with sales to unrelated buyers. Otherwise valuation moves through the prescribed alternative methods.

</details>
<details>

Can I use the price from an earlier sale in the chain?

Some jurisdictions accept first-sale valuation and others do not, and the conditions differ. Treat it as a jurisdiction-specific question for your broker rather than a technique you can assume is available.

</details>

Sources

Customs valuation — World Trade Organization

Receita Federal do Brasil — Receita Federal

Siscomex — Brazilian foreign trade system — Governo Federal do Brasil

Every figure above is traceable to these sources; where they disagree, both positions are stated.
