A cutting board, a woven basket and a folding table can all be bamboo and still land under three different NCM codes, with three different duty treatments. Getting the code wrong is the most common reason a first bamboo shipment sits in the red channel while the demurrage meter runs.

Why the code decides more than the duty rate

In Brazil the NCM (Nomenclatura Comum do Mercosul) drives four things at once:

Import duty (II) and, on some codes, IPI and PIS/COFINS-Importação.

Whether a licence or certificate is required — ANVISA for food-contact items, Mapa for plant material, Ibama for certain wood products.

Which state ICMS rule applies, including the internal tax base your accountant will use.

How Siscomex flags your entry — green, yellow, red or grey channel.

So the code is not an administrative detail filled in at the end. It determines what documents you need before the container even leaves China.

The four codes bamboo goods actually land under

NCM family

What it covers

4419

Tableware and kitchenware of bamboo — boards, bowls, cups, trays, cutlery, coasters. The default for our home and hotel ranges.

4602

Basketwork, wickerwork and other articles made directly to shape from plaiting materials — woven baskets, storage boxes with woven bodies.

4420 / 4421

Wood marquetry, ornaments and other articles of wood — decorative and non-structural bamboo items.

9403

Furniture and parts — folding camp tables, shelving, anything whose primary function is supporting weight as furniture.

The pattern to remember: function beats material. A bamboo table is furniture (9403), not tableware (4419), because its function is to hold things up, not to serve food. A woven basket is 4602 even if it is used in a kitchen.

The line that causes most disputes: a bamboo serving board with a handle. If the handle makes it a carrying tray, some despachantes will argue 4419; if it is a cutting surface, it is still 4419 — but the description matters. Always describe function in the commercial invoice, not just material.

What changes between the codes

Duty exposure. Rates differ by code and change with Mercosur decisions. We do not publish percentages here because a two-year-old number is worse than none — ask your despachante for the current TEC rate on the specific code before you price the landed cost.

ANVISA. Food-contact bamboo (4419, plates, boards, cups) can require ANVISA compliance under RDC 56/2012. Decorative items in 4420 usually do not.

Mapa. Bamboo is plant material: a phytosanitary certificate and, where applicable, fumigation or heat treatment apply regardless of code, but the inspection trigger differs.

Anti-dumping and ex-tarifário. Some furniture codes carry measures that tableware codes do not. Check before quoting retail prices.

The documents your despachante will ask for

Commercial invoice

Function-based description, material, quantity per item, unit value, Incoterm, NCM per line

Packing list

Carton count, dimensions, gross and net weight, pcs per carton

Bill of lading

Consignee matching the importer’s CNPJ registration

Certificate of origin

Only useful if a preferential agreement applies — check before paying for one

Phytosanitary / fumigation

Issued for the bamboo material, per shipment

Food-contact report

For 4419 items sold as food-contact, matching the finish used in that production batch

Three mistakes that send a container to the red channel

One NCM for a mixed container. A shipment with boards (4419) and a folding table (9403) needs both codes on the invoice. Declaring the whole container under the code of the biggest line is a classic trigger.

Invoice description that copies the marketing name. “Eco bamboo lifestyle set” tells a fiscal auditor nothing. Write “bamboo cutting board, 38 × 28 cm, item code TB-CB-301, function: food preparation”.

Certificate that does not match the batch. A food-contact report from last year’s oil supplier does not cover this year’s finish. Auditors increasingly ask for the batch reference.

How we handle it on our side

Every product page on this site carries an NCM line — and it is deliberately marked pending factory confirmation until the code is agreed for the actual configuration you are buying. We would rather show you a blank than a confident number that turns into a customs fine. When you request a quote, you get the NCM per line, the packing data measured per carton, and the documents that exist for that batch today.

If your despachante wants to argue a different classification, send us the reasoning — we have changed codes on client request before, and we will tell you when we think the change is wrong.

Questions we get on this

<details open>

Can I use one NCM for a container with several bamboo products?

No. Each distinct product line needs its own NCM on the commercial invoice. A mixed container typically carries two to four codes, and the Siscomex entry lists them separately.

</details>
<details>

Is bamboo tableware always 4419?

Almost always, when the function is food preparation or serving. Items made directly to shape from plaiting (woven baskets) fall under 4602, and furniture under 9403. Function decides, not material.

</details>
<details>

Does a bamboo product need a phytosanitary certificate even if it is finished?

Bamboo is plant material, so phytosanitary documentation applies. What changes with the degree of processing is the inspection trigger and whether fumigation or heat treatment is required. Confirm the requirement for your specific code and port of entry.

</details>
<details>

Who is responsible if the NCM is wrong?

The importer of record is legally responsible for the declaration, even when the supplier suggested the code. That is why we mark NCM values as pending until confirmed for your configuration — the decision should be yours, with our data in hand.

</details>

A five-minute check against Comex Stat

Before you accept a code on a supplier’s invoice, spend five minutes on the official import statistics. The query is simple: filter by NCM, set the period to the last twelve months, and look at what Brazil actually imported under that code.

Three patterns are worth reading carefully. A code with substantial, steady volume means the code is in use and brokers see it often, which lowers the chance of a query. A code with a large volume that is concentrated in a few importers can mean the code belongs to a different product family entirely. A code with almost no recorded imports, for a product you know sells in Brazil, usually means the trade is being declared somewhere else, and your invoice is about to look unusual.

This is a cross-check, not a ruling. Statistics tell you what other importers declared, not what is correct for your article. But they are a fast way to find out whether the code you were quoted is one that the trade recognises, and they cost nothing to consult before the goods leave the factory.

How this looks in practice: every article in our catalogue carries its reference NCM on the product page, marked as a reference rather than a ruling, and the same fields appear on the quotation form so that what you price and what you declare stay the same thing.

Duty rates, licensing requirements and Mercosur measures change. This article explains the classification logic, not the current tariff schedule — confirm the rate and requirement for your specific code with a licensed despachante before pricing a landed cost. Product-level NCM values shown on this site are pending factory confirmation.

Sources

Siscomex — Sistema de Comércio Exterior — Governo Federal.
